1. Introduction
Beach Mode Rentals ("we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, and protect your information when you use our website and rental services in San Diego, CA.
2. Information We Collect
We collect information you provide directly to us, including:
- Contact Information: Name, email address, phone number, and physical address.
- Rental Details: Driver's license information and payment details.
- Communications: Records of your interactions with us via email, phone, or SMS.
- Cart Location (GPS): Our rental carts are equipped with GPS trackers. We collect cart location data during your rental (and afterward if a cart has not been returned) for fleet operations, return confirmation, and theft prevention.
- Automatically Collected Information: When you visit our website, we and our analytics providers automatically collect usage data such as pages viewed, links clicked, approximate location, device and browser type, and referring source. See Section 4 for details.
3. SMS and Voice Communication
By providing your phone number and checking the "Opt-In" box on our booking forms, you give Beach Mode Rentals express consent to contact you regarding your rental via call or SMS.
- Purpose: Communications are limited to transactional updates, such as delivery/pickup coordination, booking confirmations, and customer support.
- Opt-Out: You can opt-out of SMS communications at any time by replying "STOP".
- Help: At any time you can get more help by replying HELP to our text messages.
- No Third-Party Sharing: We do not sell or share your mobile phone number or SMS consent with third parties or affiliates for marketing purposes.
4. Cookies, Analytics & Session Recording
We use cookies and similar technologies, and partner with third-party analytics providers, to understand how visitors use our website so we can improve it. These providers include:
- Google Analytics (GA4): Aggregate traffic and usage statistics — pages viewed, approximate location, device and browser type, and referring source.
- PostHog (product analytics & session replay): How visitors navigate and interact with the site, including page views, clicks, scrolling, and anonymized session recordings used to diagnose usability issues. These recordings mask all text you type into forms (such as your name, email, phone, and address) and are not collected on payment, identity-verification, document, lockbox, or account pages.
This information is used to operate and improve our website; it is not used to advertise to you and is not sold for money. Session recordings are retained for a limited period (currently 30 days) and then deleted. You can limit or block these technologies through your browser settings (for example, by disabling cookies or using private browsing), and you may contact us to opt out as described in Section 5.
5. California Privacy Rights (CCPA/CPRA)
If you are a California resident, the California Consumer Privacy Act (as amended by the California Privacy Rights Act) gives you the following rights regarding your personal information:
- Right to Know / Access: Request the categories and specific pieces of personal information we have collected about you, the sources, the purposes for collecting it, and any third parties with whom we share it.
- Right to Delete: Request deletion of your personal information, subject to legal exceptions (for example, completing an active rental, processing payments or refunds, complying with the law, or where the information is reasonably necessary for us to exercise or defend legal claims).
- Right to Correct: Request correction of inaccurate personal information we maintain about you.
- Right to Opt-Out of Sale or Sharing: We do not sell your personal information for money, and we do not share your contact information or SMS opt-in data for third-party marketing. Our use of website analytics cookies may be considered "sharing" for cross-context behavioral advertising under California law; you can opt out at any time on our Do Not Sell or Share My Personal Information page, and we honor Global Privacy Control (GPC) browser signals as an opt-out request.
- Right to Limit Use of Sensitive Personal Information: We use sensitive information (such as your driver's license) only as necessary to provide the rental service and as permitted by law.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights.

6. How We Use Your Information
We use your data to:
- Process and manage your golf cart or property rentals.
- Coordinate delivery and pickup logistics.
- Comply with local San Diego regulations and safety requirements.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
7. Data Retention
We keep personal information only as long as we need it, and we delete it on a schedule:
- Identity-verification records: We retain your driver's-license details and images and the verification selfie for at least four (4) years after your rental ends or is cancelled — covering California's statute of limitations for written contracts — so we can administer insurance, resolve disputes, and establish or defend legal claims. After that period, these records are automatically deleted or de-identified — retained longer only where necessary to comply with law, resolve an open dispute or claim, preserve evidence for claims that California law allows to be filed later (for example, claims involving minors, which can be brought after they turn 18), or as required by our insurers. The fact and date that your identity was verified is kept with your rental records.
- Signed rental agreements and transaction records: Your signed rental agreement — which includes copies of your verification images as an appendix to the executed contract — and records of payments, refunds, and communications are retained as business records for as long as needed to evidence the transaction, comply with legal, tax, and accounting obligations, and defend legal claims — including claims that California law allows to be brought years later, such as those involving minors.
- Facial-biometric data: The face-match template used during identity verification is processed by our identity-verification provider and is not retained by us beyond the verification itself.
- Session recordings: Retained for 30 days (see Section 4).
- Do-not-rent list: If we ban a customer for serious misconduct, we keep a one-way cryptographic hash of the driver's-license number (not the readable number itself once identity records are deleted), together with basic contact details, for as long as needed to prevent fraud and abuse and to keep our fleet and customers safe.
- Everything else: Contact and booking details, payment records (card numbers are processed by Stripe and never stored on our systems), cart GPS history, and records of our communications with you are kept only as long as reasonably necessary for the purposes described in this policy; we determine retention using criteria such as bookkeeping and tax obligations, dispute-resolution needs, and fleet-security requirements.
If a rental is associated with an incident, injury, damage claim, dispute, or chargeback, scheduled deletion for that rental's records is suspended until the matter is fully resolved.
If you ask us to delete your information earlier (see Section 5), we will honor the request except where the law permits or requires us to keep it — for example, to complete an active rental, to comply with tax obligations, or to establish or defend legal claims.
